NOTICE: This is a legally binding agreement. Read this document carefully and in its entirety. By signing this agreement, you give up your right to bring a court action to recover compensation or obtain any other remedy for any personal injury or property damage however caused arising out of your partnership in the BMW Sports LLC, dba International Skating Center of CT (ISCC) programs, now or at any time in the future.

Acknowledgement of Risk

I hereby acknowledge and agree that participation in any BMW Sports (ISCC) activities come with inherent risks. I have full knowledge and understanding of the inherent risks associated with any BMW Sports (ISCC) participation, including but in no way limited to: (1) slips, trips and falls, (2) on ice injuries, (3) athletic injuries and (4) illness, including exposure to and infection with viruses or bacteria. I further acknowledge that the preceding list is not inclusive of all possible risks associated with BMW Sports (ISCC) participation and that said list in no way limits the operation of this agreements.

In consideration of being allowed to participate in any way in the skating, Hockey, Fitness or any event or class or clinic program, related events and activities of the undersigned, acknowledge, appreciate, and agree that:

The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,

I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown of my participation in skating, hockey, fitness or any event or class or clinic, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, and assume full responsibility for my participation; and,

I willingly agree to comply with the stated and customary terms and conditions for participation in skating, hockey, fitness, or any event or class or clinic If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,

I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS BMW Sports (ISCC), their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the event (“Releases”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASES OR OTHERWISE, to the fullest extent permitted by law.

I recognize and acknowledge that there are hazards and risks of physical injury or illness to myself in attending the Premises and participating in the activities and that not all such hazards or risks can be fully eliminated. I freely and voluntarily agree to assume the full risk of death, bodily injury or property damage, regardless of severity, that I (or my child/ward) may sustain as a result of my participation in the activities or attendance at the Premises, howsoever arising, including, but not limited to, the active or passive negligence of the Releasees.

Furthermore, the novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and spreads from person-to-person contact. BMW Sports (ISCC), has put in place preventative measures to reduce the spread of communicable diseases; however, we cannot guarantee that you or your child(ren) will not become infected while attending our facilities. While we’ve implemented reasonable preventive measures, we depend on each and every visitor and their families to follow the guidelines from the Center of Disease Control, and all applicable federal, state, and local health department guidelines, rules, laws, and regulations before and while visiting our premises. We are all in this together and rely on each other to adhere to the above-mentioned guidance and legal restrictions. The undersigned fully understands and acknowledges both the known and potential dangers of utilizing our facilities, services, and programs and acknowledge that use thereof by the undersigned and/or such participating children may, despite our reasonable best efforts to mitigate such dangers, result in exposure to communicable diseases, which could result in quarantine requirements, serious illness, disability, and/or death.

Photo / Talent Release

I hereby irrevocably release, consent and allow BMW Sports (ISCC) and its agents to use my photograph, likeness, voice, as it pertains to may participation with BMW Sports (ISCC) in any manner for promotional efforts without expectation of any reimbursement for its use.

Terms and Conditions

BMW Sports (ISCC) reserves the right to revoke membership or usage privileges of any person who abuses or misuses any of the equipment or facilities located on its premises or who engages in conduct which is abusive, illegal, disruptive or poses a threat to the safety of others.

Notice to Monthly Draft Pay to Members (As Applicable)

It is my complete understanding that if we wish to terminate or change our membership in any way, I must provide notice of Cancellation to BMW Sports (ISCC) within thirty (30) days written notice prior to my withdrawal date. I understand that paying under the monthly draft plan I am subject to dues increases periodically by the facility and may adjust the monthly rate applicable to my membership category. I will be notified 30 days in advance of any rate change. I understand that my membership will be renewed on a continual basis unless notified by myself to terminate the membership. Should any pre-authorized check/charge for my monthly draft not be honored by my financial institution when received by them, then it is understood that I am responsible for that payment plus any applicable service charges. I understand that if two monthly drafts are rejected my membership will be cancelled.

I hereby further certify that I am therefore of lawful age and otherwise legally competent to sign this agreement. I further understand that the terms of this agreement are legally binding and certify that I am signing this agreement, after having carefully read it, of my own free will.
